Apart from tariff fixation, TAMP should focus on other aspects of project which include

1.      Monitoring of partners progress

2.      Periodic reviews

3.      Settlement of disputes

4.      Transparency and accountability in costing

5.      Information sharing with public

It was also felt that top management from private sectors should be given charge for entire period and make them manage it like a strategic business unit. This helps keep project away from bureaucracy, saves them from mismanagement and corruption. Also, for settlement of disputes relating to PPP involving foreign player’s fast-track courts could be constituted.

Conclusion

As seen clearly, PPP was set up for additional capacity handling, improve efficiency, productivity and quality of service but instead it gained monopolistic control and extracted unlawful gains.

It also highlights the inefficient functioning of JNPT who could have been more vigilant in the bid acceptance stage. It emphasises on the fact that PPP in essential operations like ports will achieve desired results only if proper regulatory and monitoring mechanisms including well regulated policy framework are in place.
